The SHHA Covenant Support Committee (CSC) does not patrol the neighborhood looking for covenant violations, but instead acts only upon receiving written complaints. Sandia Heights property/homeowners who are members of SHHA and have complaints about suspected covenant violations in their Unit, in an adjacent Unit, or within line-of- sight may file a formal complaint. It is the policy of the CSC to not divulge outside the CSC or the executive committee the details of a complaint, including names, addresses and specifics, for complainant and alleged violator alike. Complaints regarding covenant violations must be submitted in written form to the SHHA office. No anonymous complaints and no verbal complaints are accepted. The complainant should provide details of the complaint, including citing the exact covenant violation of note, as well as photographs, if possible, illustrating the situation.
Once a written complaint is received, the complainant should expect correspondence from the SHHA Office acknowledging receipt of the complaint. The all-volunteer CSC is responsible for follow-up actions regarding the complaint, and the complaint will be assigned to a CSC member to investigate. The CSC investigator may contact the complainant via mail, email or phone asking for clarifications about the complaint. The investigator will validate the complaint through an initial site visit. If the complaint is found to be valid, the property/homeowner who is believed to be in violation will be notified of the covenant violation via a formal letter writing process. In general, property/homeowners who have received a valid complaint will be asked to remedy the violation, or to at least call the SHHA Office to explain what the plans for remediation are, within a specified time period. Compliance inspections are conducted on an as-needed basis in the effort to pursue enforcement of the covenant violation of note.
